Terms of Service - Washman

Please read these terms carefully before using Washman services.

1. Acceptance of Terms

By accessing or using the Washman mobile application or website (the "Service"), you agree to these Terms of Use (the "Terms"). Washman (the "Company," "we," or "us") provides on-demand car wash and related services through the Service. These Terms constitute a legally binding agreement between you (the "User") and Washman. If you do not agree to all of these Terms, you must not use the Service. We may update these Terms from time to time; any changes will be effective when we post them on the Service. Your continued use of the Service after changes are posted indicates your agreement to the updated Terms.

2. Changes to Terms

Washman reserves the right to modify or revise these Terms at any time, without prior notice. We will post the updated Terms on the Service and indicate the date of revision. It is your responsibility to review the Terms periodically. If you use the Service after the date on which the Terms have been changed, you will be deemed to have accepted the new Terms.

3. Service Description

Washman provides mobile vehicle services, including car washing and detailing, at locations you specify. The Company does not operate car wash facilities itself; instead, it connects Users with third-party service providers (the "Washmen") who perform the requested vehicle services on the User's premises or chosen location. The exact services offered may include exterior washing, interior cleaning, detailing, polishing, and other vehicle care services. The Service allows Users to request, schedule, and pay for these services through the Washman app and website.

4. Service Availability

The availability of specific Services depends on your location:

Egypt: Only car wash services (e.g. exterior and interior cleaning) are available.

Dubai (UAE): All Washman services are available, including:

  • Car washing (interior and exterior).
  • Auto detailing and polishing.
  • Window tinting (with film opacity up to 50%, as permitted by UAE law).
  • Fuel delivery (only if the Washman provider holds the required UAE fuel-delivery license).

Washman reserves the right to change, restrict, or discontinue any Service without notice. Not all services are available in all areas. You understand that Washman makes no representations or warranties regarding the availability of particular services or the availability of Service providers.

5. User Eligibility and Account Registration

To use the Service, you must be at least 18 years old and capable of forming a binding contract. You must create a user account with accurate, current, and complete information, and you agree to update this information if it changes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Washman may require you to verify your identity or age, and we may refuse service or terminate accounts that we suspect are fraudulent or in violation of these Terms. You may not transfer your account or rights under these Terms to anyone else without our consent.

6. Fees, Payment and Taxes

All Services offered through Washman are subject to payment of the fees quoted in the app or website. You must pay all charges for the requested Services, including any applicable taxes. We accept payment by major credit/debit cards and other payment methods made available within the Service. All payments are processed through third-party payment processors; Washman does not itself process or store your payment card details. You authorize Washman (and our payment processors) to charge the full amount of your booking and any additional charges (such as extra time, services, or taxes) to your chosen payment method.

No Vehicle Retention: We will not retain possession of your vehicle, keys, or other personal property for non-payment of fees. You remain responsible for paying all fees for Services you have ordered, but Washman will not detain or withhold delivery of your vehicle as security for payment.

Taxes: In Dubai (UAE), all prices for Services include the applicable Value-Added Tax at 5%, as required by UAE law. You are responsible for any other taxes (such as goods and services taxes or similar) that may apply to your purchase in your jurisdiction. Washman will collect and remit taxes in accordance with applicable law. If you believe you have been charged in error, please contact us for a refund or correction.

Washman reserves the right to correct errors (including pricing errors) in the Service at any time, even after an order has been submitted, before payment is completed. If payment is not successfully collected, Washman may limit or suspend your use of the Service. You are responsible for all bank or credit card fees associated with your payments.

7. Cancellation and Refund Policy

Washman's cancellation and refund policies are designed to comply with applicable Egyptian and UAE consumer protection laws.

Egypt: In accordance with Egypt's Consumer Protection Law No. 181 of 2018, consumers generally have the right to cancel or return purchased goods or services. For online service orders (such as through our app), the law provides a right of withdrawal within seven (7) days of placing the order, and a right to a full refund within fourteen (14) days of receiving the service. In practical terms, if you cancel a scheduled service within seven (7) days of booking and before the Washman has performed the service, you are entitled to a full refund. If the service has been performed or more than seven days have passed since booking, we may deduct our reasonable costs incurred (for example, travel and supplies) but will not impose any unlawful penalty beyond actual costs. Any approved refunds will be processed promptly (typically within 14 days of cancellation), subject to verification of the claim and deduction of any lawful costs. All cancellations must be made through the Washman app or website.

Dubai (UAE): Cancellation and refund rights for Services in Dubai are governed by UAE Federal consumer protection laws and regulations. Generally, if you cancel a service request before it is performed, you will receive a full refund of any fees paid. If you wish to cancel an appointment, you must do so through the app; if you cancel within the time frame specified by Washman (as displayed when booking), no cancellation fee will apply. If you cancel after the allowed time or after the Washman has begun servicing your vehicle, Washman may charge a reasonable cancellation fee to cover actual costs (not exceeding the amount you paid). Refunds for eligible cancellations will include the full amount paid for the Service (including 5% VAT) and will be made in accordance with UAE consumer protection regulations. To the extent required by law, refunds will be issued within a commercially reasonable time (generally within 14 days of approval).

All refunds (Egypt and UAE) will be made using the original payment method, unless otherwise agreed. Washman does not provide cash refunds or credit vouchers unless required by law. Any dispute over cancellations or refunds will be resolved under the applicable laws noted in Section 16 below.

8. User Conduct and Obligations

As a condition of using the Service, you agree that you will:

  • Provide accurate, current, and complete information when creating your account and when placing orders (including your name, address, vehicle details, contact information, and any necessary authorization).
  • Be present (or have authorized access) at the service location at the scheduled time, and otherwise cooperate with the Washman in providing the Service (for example, by ensuring the vehicle is accessible and removing personal items from the vehicle).
  • Use the Service only for personal, non-commercial purposes in compliance with these Terms and all applicable laws. If you are booking a service for a business vehicle, you are responsible for ensuring that any person on whose behalf the service is provided also complies with these Terms.
  • Comply with all local regulations relevant to the requested service. For instance, if you request window tinting in Dubai, you must ensure that the tint level does not exceed 50% opacity (the legal maximum). You assume all responsibility for any fines or penalties incurred for violating vehicle regulations.
  • Pay for all Services you receive, including any additional costs or taxes.

You agree to use the Service in good faith. You must not:

  • Use the Service for any illegal purpose or in violation of any local laws or regulations.
  • Interfere with the safe and efficient operation of a Service appointment or the Washman's performance of services. This includes not harassing or threatening the Washman or other customers, and not causing dangerous conditions.
  • Provide false or fraudulent information to Washman or service providers (for example, using a stolen payment method or a non-existent booking).
  • Attempt to obtain Services through unauthorized means (for example, using someone else's account or falsifying promotional codes).
  • Resell, distribute, or transfer Services obtained through the Service to others in an unauthorized manner (for example, arranging services as part of a commercial enterprise without Washman's permission).
  • Manipulate the ratings or reviews system, or post content (such as photos or descriptions) that is not your own or infringes on the rights of others.
  • Violate any other terms of this agreement or posted policies on the Service.

Washman may monitor activity on the Service. Any violations of the above may result in immediate suspension or termination of your account at Washman's discretion, and any outstanding obligations will remain due.

9. Third-Party Services

Washman may rely on third-party services to facilitate the Service. You acknowledge and agree that:

Payment Processors: All payments are processed by third-party payment gateways. Washman is not responsible for any errors, failures, or unauthorized charges by these payment providers. You agree to pay all fees and charges associated with your use of the Service and to resolve any payment disputes directly with the payment provider.

Mapping and Routing: If the Service provides routing or mapping information (for example, to direct a Washman to your location), such information may come from third-party map services (e.g. Google Maps, Apple Maps). We do not guarantee the accuracy or availability of third-party map data.

App Stores: If you download the Washman app through a mobile app store (such as Apple's App Store or Google Play), your use of the app is also subject to the terms and conditions of those platforms. Washman and those stores are independent, and each has no responsibility for the other's actions or inactions.

Other Third-Party Content: The Service may display or link to third-party advertisements, promotions, or content. Washman does not endorse or make any representations about third-party products, services, or websites. You understand that any dealings or disputes with third-party advertisers or content providers are solely between you and the third party; Washman is not responsible for any loss or damage from such dealings.

In all cases, Washman disclaims responsibility for any liability arising from or related to the use of third-party services. If you use any third-party service in connection with the Service, you do so at your own risk and must comply with that party's terms.

10. Intellectual Property

All content, logos, trademarks, trade names, and materials (including but not limited to images, text, software, graphics, and designs) on the Washman app and website are protected by intellectual property laws and are owned by or licensed to Washman. Nothing in these Terms grants you a license to use any Washman intellectual property, except as necessary to use the Service. You agree not to copy, reproduce, modify, distribute, publicly display, or create derivative works of any content from the Service without Washman's prior written consent.

If you provide any feedback, comments, suggestions, or other submissions regarding Washman's service ("Feedback"), you grant Washman a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that Feedback into its products and services. You represent and warrant that any Feedback you provide does not violate the rights of any third party.

11. Disclaimers of Warranties

THE WASHMAN SERVICE AND ALL CONTENT, FEATURES, AND FUNCTIONALITY PROVIDED ON OR THROUGH THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WASHMAN DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

Washman does not guarantee that (a) the Service will meet your requirements, (b) the Service will be uninterrupted, timely, secure, or error-free, or (c) any defects in the Service will be corrected. We do not guarantee the quality, safety, legality, or ability of any Washman or third-party provider. We make no warranty regarding the results that may be obtained from using the Service, or the accuracy or reliability of any information provided by the Service.

You understand and agree that any services or purchases obtained through Washman are at your own risk. Any arrangement between you and a Washman (including payment, property damage, or personal injury) is solely between you and that Washman, and Washman shall have no liability for any aspect of those dealings.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, Washman's liability will be limited to the fullest extent permitted by law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WASHMAN, ITS AFFILIATES, OR ITS SUPPLIERS (INCLUDING SERVICE PROVIDERS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WASHMAN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING THE SERVICE. IN NO EVENT SHALL WASHMAN'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES (REGARDLESS OF FORM) EXCEED THE AGGREGATE AMOUNT ACTUALLY PAID BY YOU TO WASHMAN FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE LIABILITY, IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

Some jurisdictions do not allow limitations or exclusions of liability for incidental or consequential damages, so some of the above limitations may not apply to you. Where Washman is legally required to provide a remedy that cannot be disclaimed by these Terms, Washman's liability shall be limited to the minimum extent required by law. The foregoing limitations apply even if Washman has been advised of the possibility of such damages and notwithstanding any failure of essential purpose of any limited remedy.

13. Indemnification

You agree to indemnify, defend, and hold harmless Washman and its officers, directors, employees, agents, affiliates, and third-party service providers from and against any and all claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of another; (d) any Services you order or receive; or (e) any content or information that you provide. Washman will have the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of these claims. This indemnity obligation will survive the termination of these Terms and your use of the Service.

14. Termination

Washman may suspend or terminate your access to the Service at any time and for any reason, including without limitation if you breach these Terms. We also reserve the right to refuse service to anyone at any time. Upon termination of your account, your right to use the Service will immediately cease. Any provisions of these Terms which by their nature should survive (such as Sections 7 (Cancellation and Refund), 10 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 16 (Governing Law)) shall survive termination.

If your account is terminated, you remain responsible for any outstanding payments and obligations. Termination of your account or access to the Service does not limit any other right or remedy Washman may have under law or equity.

15. Miscellaneous

Entire Agreement: These Terms, together with any documents they expressly incorporate (such as the Privacy Policy), constitute the entire agreement between you and Washman with respect to the Service, superseding any prior or contemporaneous agreements or communications.

Waiver: No waiver by Washman of any term or condition of these Terms will be deemed a further or continuing waiver of such term or condition or any other term or condition. Washman's failure to enforce any right or provision under these Terms will not constitute a waiver of such right or provision.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions of these Terms will remain in full force and effect.

Notices: All notices under these Terms must be in writing. Washman may provide notices to you via email or through the Service. You may provide notice to Washman by emailing the contact address provided in the app or website. (Check the Service for the current contact email.)

Assignment: You may not assign or transfer your rights or obligations under these Terms without Washman's prior written consent, but Washman may freely assign or transfer its rights and obligations. These Terms inure to the benefit of Washman's successors and assigns.

Relationship of Parties: You and Washman are independent contractors. Nothing in these Terms creates any partnership, joint venture, agency, employment, or franchise relationship between us.

Third-Party Beneficiaries: These Terms do not and are not intended to confer any rights or remedies on any person or entity other than you and Washman.

Governing Language: Any translations of these Terms are provided for convenience only and have no legal effect. In the event of any conflict between the English text of these Terms and a translation, the English text controls.

16. Governing Law and Jurisdiction

The interpretation and enforcement of these Terms will be governed by the law of the place where the Service is provided, as follows:

Egypt: For any Services rendered in Egypt (including Cairo, Alexandria, Giza, and other locations in Egypt), these Terms and the provision of Services to you shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt. Any dispute arising out of or relating to Services provided in Egypt will be subject to the exclusive jurisdiction of the competent courts of Egypt.

Dubai (UAE): For any Services rendered in Dubai, United Arab Emirates, these Terms and your use of the Service shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute in connection with Services provided in Dubai will be subject to the exclusive jurisdiction of the courts of Dubai.

By using the Service, you agree to the application of the appropriate law and jurisdiction as specified above. If any provision of these Terms conflicts with the mandatory laws of Egypt or the UAE, the conflicting portion will be interpreted to comply with those mandatory laws, and all other provisions will remain enforceable to the fullest extent permitted by law.
